1. Definitions
In these Terms and Conditions, the following definitions apply:
- "Thammasak", "we", "us", "our" refers to the legal practice operating at 191/46 Silom Road, Suriyawong, Bang Rak, Bangkok 10500, Thailand.
- "Service" refers to any legal advisory or representation service described on our website or in an engagement agreement.
- "User", "you", "your" refers to any person accessing our website or entering into an engagement with us.
- "Agreement" refers to these Terms and Conditions together with any written engagement letter or scope of work agreed between the parties.
- "Content" refers to all text, images, and materials published on our website.
2. Acceptance of Terms
By accessing our website at thammaass or by engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.
Our services are intended for individuals who are at least 18 years of age and who have the legal capacity to enter into binding agreements. By engaging us, you confirm that you meet these requirements.
3. Description of Services
Thammasak provides civil and commercial legal services in Thailand, currently comprising three areas of practice:
- Intellectual Property Registration Guidance — advisory and filing support with the Thai Department of Intellectual Property
- Real Estate Transaction Legal Support — legal accompaniment for property purchases, sales, and leases in Thailand
- Corporate Governance and Compliance Advisory — ongoing governance review and compliance advisory for Thai limited companies
Services are available subject to a written scope of work being agreed upon in advance. We reserve the right to decline any engagement at our discretion, including where a conflict of interest exists or where the matter falls outside our areas of practice.
Our services are directed at clients in Thailand. While we assist foreign nationals resident or investing in Thailand, we do not offer services that would constitute the unauthorised practice of law in other jurisdictions.
4. Engagement Process
No engagement between Thammasak and a client is formed solely through submission of a contact form or an initial conversation. A formal engagement commences only upon the signing of a written engagement letter or scope of work, which will set out the scope of services, the fee, the payment terms, and the expected timeline. Work will not commence before this agreement is in place.
5. User Responsibilities
When using our website or services, you agree to:
- Provide accurate and complete information when submitting enquiries or engaging our services
- Respond to reasonable requests for documents or information in a timely manner
- Use our website only for lawful purposes and in a manner consistent with applicable Thai law
- Refrain from attempting to access restricted areas of our website or disrupting its operation
- Not reproduce, distribute, or modify website content without our prior written permission
6. Intellectual Property
All content on this website, including text, design, and layout, is the property of Thammasak and is protected by applicable intellectual property law. A limited, non-exclusive, non-transferable licence is granted to view the website content for personal, non-commercial use only. This licence does not extend to reproduction, redistribution, or commercial exploitation of any content.
Documents prepared by Thammasak as part of a legal engagement remain the intellectual property of Thammasak until full payment of the relevant fee has been received, at which point they are provided to the client for their use in accordance with the scope of the engagement.
7. Fees and Payment Terms
Fees for each service are stated on our website and in any engagement letter issued. All fees are denominated in Thai Baht (฿). Payment terms, including deposit requirements and the timing of final payment, will be set out in the engagement letter.
Government filing fees, Land Office charges, or other disbursements incurred on behalf of a client are not included in the stated service fee and will be disclosed and agreed upon separately before being incurred.
Invoices are payable within the period specified in the engagement letter. Late payment may result in suspension of work until outstanding amounts are cleared.
8. Refund Policy
Where work has not yet commenced on an engagement and the client wishes to withdraw, a refund of any prepaid fee may be considered at our discretion, less any reasonable administrative costs incurred. Where work has commenced, fees for work completed are non-refundable. Specific refund terms for each engagement will be stated in the engagement letter.

10. Limitation of Liability
To the extent permitted by applicable Thai law, Thammasak's liability to any client in connection with a legal engagement shall be limited to the fee paid by the client for the specific matter giving rise to the claim. We shall not be liable for indirect, consequential, or special damages arising from any matter.
Nothing in these Terms and Conditions limits our liability for fraud, wilful misconduct, or any other liability that cannot be excluded under Thai law.
11. Confidentiality
We maintain strict attorney-client confidentiality in accordance with the professional obligations imposed by the Lawyers Council of Thailand. Information shared with us in the course of an engagement will not be disclosed to third parties except as required by law, as necessary to perform the services, or with your explicit consent.
12. Termination
Either party may terminate an engagement by providing written notice. Thammasak may terminate an engagement where fees remain unpaid after reasonable notice, where a conflict of interest arises, or where the client has provided materially inaccurate information. Upon termination, fees for work completed to the date of termination are due and payable.
13. Dispute Resolution
These Terms and Conditions are governed by the laws of the Kingdom of Thailand. Any dispute arising from or relating to these terms or any engagement shall first be subject to good-faith negotiation between the parties. If unresolved after 30 days of written notice of the dispute, the matter shall be submitted to the jurisdiction of the Thai courts in Bangkok.
14. General Provisions
- Entire Agreement: These Terms and any written engagement letter constitute the entire agreement between the parties in respect of their subject matter.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force.
- Waiver: Failure to enforce any right under these Terms does not constitute a waiver of that right.
- Assignment: You may not assign your rights or obligations under any engagement without our written consent.
15. Changes to These Terms
We may update these Terms and Conditions from time to time. The revised version will be published on our website with an updated effective date. Continued use of our website or services after any update constitutes acceptance of the revised terms. Clients with ongoing engagements will be notified of material changes.
